These Terms and Conditions (“Terms”) govern the travel services provided by Casa de Ellison Travel, LLC (referred to as “the Advisor,” “we,” “us,” or “our”). By using our services, you (“the Client” or “you”) agree to comply with these Terms.

Important Notice Regarding Your Booking
IMPORTANT ADDITIONAL INFORMATION REGARDING YOUR BOOKING: You must not accept or confirm any travel arrangements unless you fully understand and agree with these Terms and Conditions. By booking travel services through Casa de Ellison Travel, LLC, you acknowledge that you have read, understood, and accepted these Terms, which form a binding legal agreement between you and Casa de Ellison Travel, LLC.

 

1. Acceptance of Terms

1.1 Agreement

Your use of Casa de Ellison Travel, LLC’s services constitute your agreement to these Terms. IF YOU DO NOT AGREE, YOU MUST NOT USE OUR SERVICES. We recommend reading these Terms thoroughly before confirming a booking or paying any service fee.

1.2 Conspicuous Disclosure

By acknowledging these Terms (through electronic acceptance, signature, or other method), YOU EXPRESSLY AGREE to the disclaimers of warranties, limitations of liability, and dispute resolution (including arbitration) provisions contained herein, which are governed by the Federal Arbitration Act and applicable Texas law.

1.3 Age and Legal Capacity

By using our services, you represent and warrant that you are at least eighteen (18) years of age (or the age of majority in your jurisdiction) and possess the legal authority to create a binding legal obligation. If you are booking on behalf of other travelers, you further represent that you have the authority to accept these Terms on their behalf.

 

2. Services Provided

We offer travel planning and booking services, including but not limited to accommodations, tours, car rentals, flights, event tickets, and related travel activities (“Travel Arrangements”). We facilitate bookings with independent third-party suppliers (“Suppliers”) on your behalf. While we strive to recommend reputable Suppliers, we do not control their operations and are not responsible for their performance or non-performance. We cannot be held liable for dissatisfaction, inconvenience, or damages arising from Suppliers’ services, including changes, cancellations, or unforeseen circumstances.

2.1 Commission and Compensation

You acknowledge that Casa de Ellison Travel, LLC may receive commissions, referral fees, or other compensation from Suppliers or third parties related to your bookings. You agree that we may retain any such amounts in addition to the non-refundable service fee described in Section 5.3.

2.2 No Guarantee of Specific Outcomes

While we endeavor to recommend reputable Suppliers and provide accurate information, we do not guarantee any particular outcome, level of satisfaction, or success of your travel experience. Travel involves inherent risks, and you acknowledge that outcomes may vary.

2.3 Independent Contractor Status

Casa de Ellison Travel, LLC acts solely as an independent contractor in arranging and coordinating your travel services. Nothing in these Terms creates any partnership, joint venture, or agency relationship between Casa de Ellison Travel, LLC and you or between Casa de Ellison Travel, LLC and any Supplier. Casa de Ellison Travel, LLC is not responsible for, nor does it assume any liability for, any acts or omissions of Suppliers or other third parties.

Casa de Ellison Travel, LLC acts solely as an agent for disclosed suppliers and does not own, operate, or control any travel service provider. We make no representations or warranties regarding the financial condition of any supplier and assume no liability for their acts, errors, or omissions. We have no special knowledge of the financial condition of any supplier or of their ability to honor future travel credits or refunds.

 

3. Client Responsibilities

3.1 Accurate Information

You are responsible for providing and verifying complete and accurate information for all Travel Arrangements, including legal names, contact details, special requests, and any other details required.

3.2 Liability for Inaccurate Information

We are not liable for costs or losses incurred due to inaccurate or incomplete information you provide.

3.3 Supplier Terms

You must review and agree to each Supplier’s terms and conditions. Where a Supplier’s specific terms conflict with these Terms regarding that Supplier’s services (e.g., refunds, cancellations), the Supplier’s terms will control solely for that Supplier’s portion of your travel, but these Terms otherwise remain applicable.

3.4 Knowledge of Laws and Entry Requirements

You must be aware of and comply with all laws, regulations, and entry requirements (e.g., visas, vaccinations, customs, impact of criminal convictions) of the destinations you plan to visit. While we may offer general guidance, ultimate responsibility rests with you.

Casa de Ellison Travel, LLC has no special knowledge of unsafe conditions, health hazards, weather patterns, or climate extremes at destinations. Clients are encouraged to review current travel advisories and health information from the U.S. Department of State (www.travel.state.gov) and the Centers for Disease Control and Prevention (www.cdc.gov/travel) before departure.

3.5 Review and Confirmation of Final Itinerary

You are responsible for reviewing all details of the final itinerary (including dates, times, and traveler information) upon receipt. You must promptly notify us of any inaccuracies or discrepancies. Casa de Ellison Travel, LLC is not liable for any issues arising from errors or omissions in the itinerary that were not brought to our attention within a reasonable time after receipt.

3.6 Verification of Communications

You are responsible for exercising reasonable caution when receiving travel-related communications, including emails, text messages, or phone calls requesting payment or personal information. Casa de Ellison Travel, LLC will not request sensitive payment information via unsolicited text message or unsecured link.

If you receive any communication requesting payment, verification, or personal data that you did not initiate or that appears suspicious, you agree to contact Casa de Ellison Travel, LLC directly before taking action. Failure to do so may result in financial loss for which Casa de Ellison Travel, LLC is not responsible.

 

 

4. Travel Documents

4.1 Client Responsibility

You are responsible for ensuring all required travel documents (e.g., valid passports, visas, health certificates) are current and valid.

4.2 Liability for Missing Documents

We are not liable for any costs or losses arising from your failure to obtain or maintain necessary travel documents.

4.3 Health and Accessibility

It is your responsibility to ensure that you are medically and physically fit for travel and to inform Casa de Ellison Travel, LLC of any health conditions, mobility limitations, or special requirements at the time of booking. Some destinations may require proof of vaccination or impose entry restrictions. You are solely responsible for complying with all health, vaccination, and accessibility requirements of the countries and suppliers involved in your travel.

4.4 Pre-Existing Medical Conditions & Insurance Responsibility

Casa de Ellison Travel, LLC is not licensed to sell or provide insurance advice, does not evaluate medical conditions, and does not determine whether a traveler’s health history may affect insurance eligibility or pre-existing condition coverage.

It is the client’s sole responsibility to:

Determine whether any medical condition, diagnosis, symptom, treatment, or medication may be considered a pre-existing condition under the applicable insurance policy;

Disclose all necessary medical information directly to the travel insurance provider, and to consult with the insurer regarding coverage limitations, exclusions, waiting periods, or pre-existing condition waivers;

Notify Casa de Ellison Travel, LLC only if assistance is needed in contacting the insurer or obtaining general information about available insurance options.

Clients understand and agree that:

Failure to disclose relevant medical information to the insurance provider may result in denied claims or reduced benefits;

All insurance claim determinations, benefit decisions, denials, approvals, and exclusions are made solely by the insurance provider and are governed by the insurance policy terms;

Casa de Ellison Travel, LLC is not responsible for any insurance claim denial, limitation, reduction, or coverage decision—regardless of the reason, including but not limited to pre-existing conditions, policy exclusions, misstatements, incomplete information, or insurer discretion;

Any questions regarding medical eligibility, coverage interpretation, or pre-existing condition waivers must be directed to the insurance carrier, not to Casa de Ellison Travel, LLC.

 

5. Payment and Service Fees

5.1 Payment Authorization and Processing

In most cases, Casa de Ellison Travel, LLC will obtain payment authorization from you to apply payments directly to the appropriate travel supplier, tour operator, cruise line, or airline. This is done securely through our client management system. In some cases, you may be asked to submit payment directly to the supplier or to our host agency. Regardless of the method, you agree to comply with all supplier terms, deadlines, and conditions. Casa de Ellison Travel, LLC does not accept responsibility for supplier changes, cancellations, or failures to process payments when authorization is delayed or declined.

5.2 Prices

All prices are subject to change without notice and are not guaranteed until confirmed by the supplier. Pricing may vary due to currency fluctuations, fuel surcharges, government taxes, and other factors beyond our control. You acknowledge and consent to any supplemental price increases, surcharges, or tax changes imposed by suppliers or government authorities prior to full payment.

5.3 Service and Planning Fees

Casa de Ellison Travel, LLC charges a non-refundable service or planning fee for custom itinerary design, research, consultation, and travel planning. This fee is separate from any travel booking costs and is due before any research or travel planning begins. The service fee is non-refundable once paid.

5.4 Air Booking Fee

Casa de Ellison Travel, LLC may charge a separate, non-refundable fee for flight research and airline ticket booking (“Air Booking Fee”). This fee covers the time, expertise, and administrative services involved in securing airfare, monitoring flight schedules, and managing post-booking support. The Air Booking Fee is assessed per traveler (or per booking) and is due at the time of air ticketing authorization. This fee is non-refundable, even if travel plans change or are canceled by the client or the airline.

5.5 Authorization to Book

By providing written or electronic approval (including but not limited to email confirmation), you authorize Casa de Ellison Travel, LLC to secure travel arrangements on your behalf with the appropriate suppliers. You acknowledge that you remain solely responsible for all charges associated with such bookings and agree to remit payment directly to the supplier or through an authorized payment system as instructed.

Chargebacks related to fraudulent third-party communications, phishing incidents, or supplier data breaches shall not constitute unauthorized charges when services were authorized and booked as requested.

5.6 Special Notice for Florida and California Clients

Casa de Ellison Travel, LLC complies with applicable Seller of Travel requirements for clients residing in California or Florida.

Travel arrangements (supplier payments). With your written authorization captured through our client management system (e.g., TravelJoy), we may process your card and remit payment directly to the supplier, consolidator, an ARC-accredited partner, or to our host agency’s registered trust/merchant account. In these cases, the supplier or host is the merchant of record.

Professional service fees (planning fees, air booking fees, concierge, etc.). These are charges for our services—not payments toward travel products—and are processed through our host agency, Travel Planners International (TPI), a registered Seller of Travel. On your card statement, these fees may appear as “Travel Agency Services – Airlines Reporting Corporation.”

5.7 Changes to Itinerary and Associated Fees

Once an itinerary has been booked, any changes requested by the client may incur additional fees. Casa de Ellison Travel, LLC reserves the right to assess a change fee for modifications to your itinerary, which is separate from and in addition to any change fees, penalties, or fare differences imposed by suppliers, airlines, or other travel service providers. All change fees will be communicated to the client in advance and must be paid prior to implementing any requested modifications.

5.8 Chargebacks / Disputed Payments

If you initiate a chargeback or reverse a payment with your payment provider (e.g., credit-card issuer or bank) for any amounts due under these Terms (including service fees, planning fees, air booking fees, or payments to suppliers), you acknowledge and agree that:

You will be immediately liable to Casa de Ellison Travel, LLC for the full amount of the chargeback, plus any associated merchant processor fees, penalties, or administrative costs incurred as a result of the dispute.

We reserve the right to suspend or cancel any pending travel arrangements until the dispute is resolved and payment is restored in full.

You expressly waive any right to initiate a chargeback in cases of supplier cancellation, schedule change, or force majeure, provided that the charge was authorized and services were booked as requested.

You agree to cooperate in good faith by providing supporting documentation, authorizations, and communications necessary to assist in resolving the dispute.

If a charge appears on your statement under a merchant descriptor such as “Travel Agency Services – Airlines Reporting Corporation” or under the name of a supplier, consolidator, or host agency (e.g., Travel Planners International), you acknowledge that these are legitimate charges processed under Casa de Ellison Travel, LLC’s authorization and do not constitute unauthorized or fraudulent transactions.

This clause survives termination of this agreement and remains enforceable after services are completed.

 

5.9 Early Payment Collection Requirement

To ensure timely processing with suppliers and to prevent issues such as declined cards, processing delays, supplier time-zone differences, system outages, or automatic cancellation for non-payment, Casa de Ellison Travel, LLC may require final payment to be collected prior to the supplier’s stated payment deadline. By using our services, you authorize Casa de Ellison Travel, LLC to request and process payment early when necessary to meet supplier requirements and protect your reservations. You acknowledge that failure to provide payment by the requested date may result in cancellation, loss of pricing, loss of promotions, or forfeiture of the reservation, for which Casa de Ellison Travel, LLC is not liable.

 

6. Group Travel / Group Bookings

6.1 Definition of Group

For purposes of these Terms, a “Group” refers to any reservation involving eight (8) or more travelers sharing the same or substantially similar itinerary, destination, or travel dates. Group reservations are often subject to special pricing, contract terms, and deadlines established by the supplier.

6.2 Group Leader / Contracting Party

Each group must designate a single individual (“Group Leader”) as the main point of contact and contracting party. Casa de Ellison Travel, LLC will communicate primarily with the Group Leader, who is authorized to act on behalf of all travelers for purposes of confirming arrangements, making payments, approving changes, and receiving notices. It is the Group Leader’s responsibility to share all information and updates with the rest of the group.

6.3 Deposits and Payments

Deposits are required to confirm group space and are non-refundable unless otherwise specified in writing by the supplier. A payment schedule will be provided at the time of booking, typically consisting of an initial deposit followed by final payment either on the supplier’s deadline or no later than forty-five (45) days before departure, whichever occurs first. Failure to pay by the stated deadlines may result in automatic cancellation of the affected reservations and loss of all payments made to date.

6.4 Name Lists and Documentation

Final traveler names (exactly as they appear on government-issued identification), rooming or cabin assignments, and any special requests must be provided no later than ninety (90) days before departure unless the supplier requires an earlier date. After this deadline, name corrections, additions, or substitutions may incur additional supplier fees and are subject to availability.

6.5 Substitutions and Participant Changes

Substitutions of participants may be allowed at the supplier’s discretion and are subject to applicable change fees or fare differences. The Group Leader must submit all substitution requests in writing. Casa de Ellison Travel, LLC cannot guarantee that a supplier will permit substitutions after tickets, rooming lists, or manifests have been finalized.

6.6 Minimum Group Size and Price Adjustments

Group pricing and benefits are typically based on a minimum number of fully-paid participants. If the group falls below the required minimum, suppliers may adjust pricing, cancel group concessions, or convert the booking to individual rates. Casa de Ellison Travel, LLC reserves the right to revise quoted prices or itineraries in such cases.

6.7 Planning Fees and Air Booking Fees

Casa de Ellison Travel, LLC may assess planning or air-booking fees for group coordination. These fees, if applicable, will be disclosed prior to engagement and may be charged per traveler or per group. Unless otherwise specified, such fees are non-refundable once paid and are separate from supplier deposits or payments.

6.8 Non-Payment and Forfeiture

If any group member or the Group Leader fails to make required payments by the deadlines provided, Casa de Ellison Travel, LLC and the supplier reserve the right to cancel the booking. All deposits and payments made up to that point will be forfeited. Reinstatement of canceled reservations, if permitted, may result in higher rates or additional fees.

6.9 Changes and Cancellations

Individual or group-wide cancellations are governed by supplier terms and conditions. Group members are responsible for all applicable penalties, fare differences, or administrative costs associated with changes or cancellations. Casa de Ellison Travel, LLC will assist with coordination but cannot guarantee that any fees or penalties will be waived.

6.10 Force Majeure

Section 9 (Force Majeure) of these Terms applies equally to all group bookings.

6.11 Fitness to Travel

Casa de Ellison Travel, LLC and participating suppliers reserve the right to decline to accept or to remove from a group any traveler who, in their sole discretion, is deemed unfit to participate or whose behavior is disruptive to the group’s enjoyment or safety. No refunds will be issued under such circumstances.

 

 

7. Travel Insurance

 

We strongly recommend that all clients purchase comprehensive travel insurance (covering trip cancellation, interruption, delay, medical expenses, and other unforeseen events). Casa de Ellison Travel, LLC has explained the availability of such insurance.

If you accept coverage, you agree to review the policy terms carefully and understand that Casa de Ellison Travel, LLC is not responsible for claim determinations made by the insurer.

If you decline coverage, you acknowledge and accept full responsibility for any financial losses or expenses incurred as a result of cancellation, interruption, medical emergencies, or other unforeseen events.

 

8. Cancellations and Changes

 

8.1 Supplier Policies

 

All cancellations, changes, or refunds are subject to each Supplier’s policies. We will assist in facilitating changes or cancellations where possible but cannot guarantee any waiver of fees or penalties.

 

Refunds for cancellations or unused services are issued solely by the respective suppliers in accordance with their terms. Casa de Ellison Travel, LLC is not responsible for the timing, approval, or processing of any such refunds once submitted.

 

8.2 Client Responsibility for Fees

Any fees or penalties (including but not limited to cancellation and change fees) are your responsibility.

8.3 Cybersecurity, Fraud, and Third-Party Communications

Casa de Ellison Travel, LLC is not responsible for and shall not be liable for losses, damages, or unauthorized transactions arising from data breaches, cybersecurity incidents, phishing attempts, spoofed communications, or fraudulent activity originating from third-party suppliers, service providers, or unknown actors. This includes, but is not limited to, fraudulent emails, text messages, phone calls, or websites purporting to be associated with a supplier or travel provider.

You acknowledge that suppliers, hotels, airlines, tour operators, and other third parties may communicate directly with you and that Casa de Ellison Travel, LLC has no control over the security practices, systems, or data handling of such third parties. If you voluntarily provide personal or payment information in response to a communication not sent directly by Casa de Ellison Travel, LLC, you do so at your own risk.

Casa de Ellison Travel, LLC shall not be liable for any resulting financial loss, identity theft, or unauthorized charges arising from such incidents.

 

 

9. Disclaimer of Warranties & Limitation of Liability

9.1 Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW (AND, WHERE APPLICABLE, THE FEDERAL ARBITRATION ACT), CASA DE ELLISON TRAVEL, LLC HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY AS TO THE RELIABILITY, ACCURACY, OR COMPLETENESS OF ANY INFORMATION PROVIDED BY SUPPLIERS OR OTHER THIRD PARTIES.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW:

NEITHER CASA DE ELLISON TRAVEL, LLC NOR ITS AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO ANY TRAVEL SERVICES PROVIDED BY THIRD-PARTY SUPPLIERS.

THIS INCLUDES, WITHOUT LIMITATION, LOST DEPOSITS, CANCELLATIONS, ACTS OF NATURE, FORCE MAJEURE EVENTS, OR OTHER CIRCUMSTANCES BEYOND OUR CONTROL.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THESE TERMS OR TO OUR SERVICES SHALL NOT EXCEED THE NON-REFUNDABLE SERVICE FEE PAID TO CASA DE ELLISON TRAVEL, LLC.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (E.G., PERSONAL INJURY OR DEATH RESULTING FROM OUR NEGLIGENCE).

 

9.3 Assumption of Risk

Travel involves inherent risks, including but not limited to illness, communicable disease, injury, adverse weather, natural disasters, political instability, acts of terrorism, and other events beyond our control. By booking through Casa de Ellison Travel, LLC, you voluntarily assume all such risks and agree to hold us harmless for any resulting loss, injury, or damage except as expressly provided in Section 9.2.

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms when such failure or delay results from circumstances beyond our reasonable control (e.g., natural disasters, pandemics, strikes, acts of terrorism, war, government travel restrictions). No refunds, reimbursements, or credits are guaranteed in these circumstances.

 

11. Dispute Resolution

11.1 Mediation

In the event of any dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve such dispute via mediation in Comal County, Texas.

11.2 Arbitration

If mediation fails, the dispute shall be submitted to final and binding arbitration in Comal County, Texas, under the Federal Arbitration Act and the applicable rules of the American Arbitration Association (or a similar recognized body).
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU ARE WAIVING ANY RIGHT TO A TRIAL BY JURY.
You also acknowledge and agree that:
• Any legal claims or disputes shall be governed exclusively by Texas law, without regard to conflict of law principles.
• Jurisdiction and venue lie exclusively in Comal County, Texas.

11.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. NO ARBITRATOR OR JUDGE MAY CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED WITHOUT THE EXPRESS CONSENT OF ALL PARTIES.

11.4 Time Limitation to Bring Claims

ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES PROVIDED BY CASA DE ELLISON TRAVEL, LLC MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE. OTHERWISE, SUCH CLAIM OR CAUSE OF ACTION IS PERMANENTLY BARRED.

11.5 Attorneys’ Fees

In the event of any arbitration or legal proceeding arising out of or relating to these Terms, the prevailing party shall be entitled to recover its reasonable attorneys’ fees, court or arbitration costs, and other expenses incurred in enforcing its rights under these Terms, to the fullest extent permitted by law.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless Casa de Ellison Travel, LLC, its employees, officers, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or connected with:

Your breach of these Terms.

Your misuse of our services.

Your violation of any applicable law, rule, or regulation.

 

 

13. Airline Policies, Seating, and Identification Requirements

13.1 Airline Policies

Airline policies regarding baggage fees, seating assignments, check-in procedures, and boarding requirements are subject to change at any time without prior notice. Casa de Ellison Travel, LLC is not responsible for any additional charges assessed by the airline, including but not limited to fees for checked baggage, carry-on baggage, overweight/oversized baggage, seat selection, or premium seating upgrades.

 

13.2 Seating Assignments

Seat assignments are controlled exclusively by the airline. If premium seating (including but not limited to preferred location, additional legroom, or comfort seats) is not purchased at the time of booking, the traveler must log into the airline’s website or mobile application after ticketing to secure or upgrade seating. Casa de Ellison Travel, LLC does not guarantee or arrange seat assignments once a ticket has been issued.

13.3 Flight Reconfirmation and Check-In

Travelers are strongly advised to reconfirm all flight details directly with the airline within twenty-four (24) hours prior to scheduled departure, as last-minute changes, delays, or cancellations may occur without advance notice. Most airlines permit online check-in beginning twenty-four (24) hours prior to departure.

13.4 REAL ID Act Compliance

Pursuant to the REAL ID Act of 2005 and Transportation Security Administration (TSA) regulations, effective May 7, 2025, all travelers 18 years of age and older must present a valid REAL ID-compliant driver’s license or another form of federally accepted identification (such as a valid U.S. passport or military ID) in order to board domestic flights within the United States. It is the traveler’s responsibility to ensure possession of proper identification in accordance with these requirements. Casa de Ellison Travel, LLC is not liable for denial of boarding, missed flights, or additional expenses incurred due to non-compliance with REAL ID or other government-mandated identification standards.

13.5 Booking Air on Behalf of Client

Casa de Ellison Travel, LLC may, at the client’s request, arrange and book airline tickets for domestic and international travel. Air bookings may be made directly with airlines, through air consolidators, or through third-party partners such as Regal Wings.

All airfare is purchased using the client’s credit card or payment information, and the client authorizes Casa de Ellison Travel, LLC to use that information solely for the purpose of securing the agreed-upon flights. Casa de Ellison Travel, LLC does not operate a Global Distribution System (GDS) and therefore acts only as an intermediary in facilitating the air purchase.

Clients acknowledge and agree that:

Supplier Control – Airlines, consolidators, and partners control all ticketing, fare rules, changes, and refund policies. Casa de Ellison Travel, LLC is not responsible for seat assignments, flight schedule changes, cancellations, delays, lost baggage, or any service failures by the carrier or consolidator.

Fare Rules and Restrictions – Airline tickets are subject to specific fare rules, which may limit refunds, exchanges, or upgrades. The client is responsible for reviewing these rules prior to ticketing.

Name Accuracy – The client must ensure that all names exactly match the traveler’s government-issued identification. Any correction, exchange, or reissue may result in additional airline or consolidator fees.

Schedule Changes and Reissues – Casa de Ellison Travel, LLC will assist, when possible, in facilitating voluntary or involuntary flight changes, reissues, or cancellations. However, the airline or consolidator’s policies and fees will govern all such transactions.

Refunds – Any applicable refunds for canceled or unused tickets are issued solely by the airline or consolidator in accordance with their terms. Casa de Ellison Travel, LLC is not responsible for the timing or processing of such refunds once submitted.

Client Responsibility – The client is responsible for reconfirming flight schedules directly with the airline prior to travel, as flight times and aircraft may change without notice.

13.6 Refusal of Service

Airlines, cruise lines, hotels, tour operators, and other suppliers reserve the right to refuse service to any traveler who fails to present proper documentation, appears intoxicated or unfit for travel, engages in disruptive or unsafe behavior, or otherwise violates supplier policies. Casa de Ellison Travel, LLC is not responsible for any denial of service, removal from a vessel or property, or additional costs resulting from such circumstances.

 

14. Privacy & Data Handling

We respect your privacy and handle personal data in accordance with our Privacy Policy, which is incorporated by reference into these Terms. We collect only the information necessary to deliver the requested travel services and do not share personal data with third parties except as needed to process bookings or comply with legal requirements.

 

15. Conflict with Supplier Terms

If any term in a Supplier’s agreement conflicts with these Terms, the Supplier’s terms shall control only with respect to that Supplier’s particular services or products. All other provisions of these Terms remain in full force and effect.

 

16. Severability

If any provision of these Terms is held invalid or unenforceable by a court or arbitrator of competent jurisdiction, all remaining provisions shall remain in effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to render it valid and enforceable.

 

17. Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. Your continued use of our services after any updates become effective constitutes your acceptance of the updated Terms. You are responsible for reviewing these Terms periodically for changes.

 

18. Entire Agreement

These Terms, along with any other documents expressly incorporated by reference, constitute the entire agreement between you and Casa de Ellison Travel, LLC with respect to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written. You acknowledge that you have not relied on any representation, warranty, or statement not expressly set out in these Terms. 19. No Third‐Party Beneficiaries

These Terms do not, and are not intended to, confer any rights or remedies upon any person or entity other than the parties.

Neither party may assign or transfer these Terms or any rights or obligations hereunder without the other party’s prior written consent, except that Casa de Ellison Travel, LLC may assign these Terms, without restriction, in connection with a merger, acquisition, reorganization, or other corporate transaction.

 

21. Electronic Communications, Headings & Waiver

21.1 Electronic Communications.

You consent to receive all notices, disclosures, confirmations, invoices, and updates under these Terms electronically (e.g. by email to the address you provide). Electronic delivery constitutes written notice.

21.2 Headings.

Section titles and headings are for convenience only and do not affect interpretation of these Terms.

21.3 Waiver.

No delay or failure by either party in exercising any right under these Terms constitutes a waiver of that right. Any waiver must be in writing and signed by the party granting it.
